Dabah Terms and Conditions

Welcome to Dabah! These Terms and Conditions govern your use of the Dabah mobile application and website (the "Platform"). By accessing or using Dabah, you agree to comply with and be bound by these terms. If you do not agree with these terms, please do not use the Platform.

1. Acceptance of Terms

By registering, accessing, or using Dabah, you acknowledge that you have read, understood,and agree to these Terms and Conditions, as well as our Privacy Policy.

2. User Accounts

● You must be at least 16 years of age to use dabah. By using this platform or creating an account, you confirm that you meet this minimum age requirement. We do not knowingly allow anyone under 16 to use dabah or create an account. If we learn that we have collected personal data from someone under the age of 16, we will delete the data and suspend the account.

● You are responsible for maintaining the confidentiality of your account credentials.

● You agree to provide accurate and up-to-date information.

● You may not use another user’s account without permission.

3. Content and Usage

● Dabah allows users to upload, share, and interact with recipes and related content.

● By uploading content, you affirm that you have the necessary rights to share it and grant Dabah a non-exclusive, worldwide, royalty-free license to use, display, and distribute thecontent.

● Users must not upload content that is illegal, offensive, infringing, or violates any third-party rights.

● Dabah reserves the right to remove or modify content that violates these terms or isdeemed inappropriate.

4. Prohibited Activities

Users must not:

● Use Dabah for any illegal or unauthorized purposes.

● Post or distribute malicious software, spam, or unauthorized advertising.

● Harass, abuse, or impersonate other users.

● Attempt to disrupt or compromise the security of the Platform.

● Violate any applicable laws or regulations.

5. Intellectual Property

● Dabah and its associated trademarks, logos, and software are owned by or licensed to Dabah and are protected under applicable intellectual property laws.

● Users retain ownership of their uploaded content but grant Dabah a right to use it as described in Section 3.

6. DMCA Policy

Dabah respects the intellectual property rights of others and complies with the Digital millennium Copyright Act (DMCA). If you believe that content uploaded to Dabah infringes your copyright, you may send a DMCA takedown notice to our designated agent with the following information:

1. Your Contact Information – Your name, mailing address, email, and phone number.

2. Identification of the Infringing Content – A description of the copyrighted work and its location on Dabah.

3. A Statement of Good Faith – A statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent, or the law.

4. A Statement of Accuracy – A declaration, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

5. Your Signature – A physical or electronic signature of the copyright owner or their representative.

Counter-Notification Process

If you believe that your content was mistakenly removed due to a false or incorrect DMCA claim, you may submit a counter-notification that includes:

● Your contact information (name, address, phone number, email).

● Identification of the removed content and where it was previously located.

● A statement, under penalty of perjury, that you have a good faith belief that the content was removed as a result of mistake or misidentification.

● Your consent to the jurisdiction of the relevant courts and agreement to accept service of process from the original complainant.

● Your signature (physical or electronic).

Upon receiving a valid counter-notification, we may restore the content unless the original complainant files a court action seeking to restrain its use.

Repeated violations of copyright law may result in account termination.

7. Liability and Disclaimers

● Dabah is provided on an "as is" basis without warranties of any kind.

● We do not guarantee the accuracy, reliability, or safety of user-uploaded content.

● We are not responsible for any losses, damages, or disputes that arise from your use of the Platform.

8. Termination

● Dabah reserves the right to suspend or terminate accounts that violate these Terms and Conditions.

● Users may delete their accounts at any time, but some content may remain visible depending on prior interactions.

9. Subscriptions

Subscription Period

● Some features of Dabah are available only with a paid subscription. Subscriptions ar billed in advance on a recurring basis (daily, weekly, monthly, or annually) based on the selected plan.

● Subscriptions automatically renew unless canceled before the end of the billing period.

Subscription Cancellations

● Users may cancel subscriptions via account settings or by contacting Dabah support. No refunds will be issued for the current billing period.

● If the subscription was purchased through an in-app purchase, cancellations must be managed through the respective application store.

Billing

● Users must provide accurate billing details. If automatic billing fails, an invoice will be sent with a deadline for manual payment.

Fee Changes

● Dabah reserves the right to change subscription fees. Users will receive prior notice and may cancel before changes take effect.

Refunds

● Subscription fees are non-refundable except when required by law. Refund requests may be reviewed on a case-by-case basis and granted at the sole discretion of the Company.

● If the Subscription has been made through an In-app purchase, the Application Store's refund policy will apply. If You wish to request a refund, You may do so by contacting the Application Store directly.

Free Trial

● Dabah may offer free trials. Users who provide billing details will be charged after the trial ends unless canceled.

In-App Purchases

● In-app purchases are non-refundable and handled by the respective application store.

● You acknowledge and agree that all billing and transaction processes are handled by the Application Store from where you downloaded the Application and are governed by that

Application Store's own terms and conditions. If you have any payment related issues with In-app Purchases, then you need to contact the Application Store directly.

● Promotions

● Promotional offers may have separate terms. In case of conflicts, the promotion terms will apply.

10. Governing Law These Terms and Conditions shall be governed by and interpreted under the laws of the State

of New York, United States. Any disputes arising under these terms shall be resolved in the courts of New York.

International Clause

For users outside the United States, you agree that any disputes shall be resolved in accordance with the laws of New York, and you consent to the exclusive jurisdiction of the courts in New York, USA. If local laws in your country require different dispute resolution methods, we will comply with applicable local laws to the extent required.

European Union (EU) Compliance

For users located in the European Union (EU), these Terms and Conditions shall comply with applicable EU laws, including the General Data Protection Regulation (GDPR). If you are an EU resident, you may have additional rights regarding data access, correction, and deletion. Any disputes arising under these Terms shall be governed by the laws of New York, unless local laws require otherwise.
